- 1 DEFINITIONS
Dni robocze – dni od poniedziałku do piątku za wyjątkiem dni ustawowo wolnych od pracy.
Konto – uregulowana odrębnym regulaminem nieodpłatna funkcja Sklepu (usługa świadczona drogą elektroniczną), dzięki której Kupujący może założyć w Sklepie swoje indywidualne Konto.
Konsument – konsument w rozumieniu przepisów Kodeksu cywilnego.
Kupujący – każdy podmiot kupujący w Sklepie.
Regulamin – niniejszy regulamin.

- 3 TECHNICAL REQUIREMENTS
- For the correct functioning of the Shop there is needed:
- device connected to the internet
- internet browser supporting Javascript and cookie files
- For completion of an order in the Shop, apart from the requirements mentioned in par.1, an active email account is necessary.
- 4 PURCHASES IN THE SHOP
- Prices of products shown in the Shop are total prices for the products, including the VAT tax.
- Seller points out that the total price of the order comprises, indicated in the Shop, total price of the product and, if applicable, cost of delivery.
- Chosen product ought to be added to cart in the Shop.
- Next, the Buyer chooses from the available in the Shop: the delivery method of the product, the payment method and provides the data necessary to complete the order.
- The order is placed when its contents are confirmed and the Regulations are accepted by the Buyer.
- The basis of the concluding of a sale contract between the Buyer and the Seller is placing an order.
- Confirmation of the conclusion of the contract will be provided by the Seller on a durable medium to the Buyer at the moment of the product delivery at the latest.
- The Buyer may register in the Shop, i.e. create an Account in the Shop or make purchases without registration through providing their data with every possible order.
- PAYMENTS
- The payment for the order can de done depending on the choice of the Buyer:
- Through the payment platform:
- PayU
- If the Buyer selects payment in advance, the order must be paid within 1 Workday of placing the order.
- The Seller informs that in case of some payment methods, due to their specific nature, paying for the order using those methods might be only possible directly after placing the order.
- 6 ORDER FULFILLMENT
- The Seller is obliged to deliver faultless products.
- The order fulfillment date is stated in the Shop.
- If the Buyer has chosen to pay in advance for the order, the Seller will proceed with completion of the order after it is paid for.
- If the Buyer purchased several items in the course of one order and their order fulfillment date differs, the order will be processed on the date appropriate for the product with the longest date.
- Countries where the delivery is carried out:
- the Republic of Poland
- the whole world
- Products purchased in the Shop are delivered depending on what method of delivery was chosen by the Buyer:
- Electronically – in case of digital content
- 7 RIGHT TO WITHDRAW FROM THE CONTRACT
- The consumer may withdraw from the contract concluded with the Seller via the Shop, subject to § 8 of the Regulations within 14 days without giving any reason whatsoever.
- The deadline for withdrawal from the contract expires within 14 days from the day:
- in which the Consumer acquired the product or a third party other than the carrier acquired this product.
- in which the Consumer acquired the last of items or in which the third party, other than the carrier, acquired the last of items in case of a contract requiring the transfer of ownership of many items which are delivered separately.
- conclusion of the contract – in case of contract for providing digital content
- In order for the Consumer to exercise the right to withdraw from the contract, he must inform the Seller, using the data provided in § 2 of the Regulations, of his decision to withdraw from the contract by an unequivocal statement (e.g. a letter sent by post or information sent by email).
- The consumer may use the model withdrawal form at the end of the Regulations, but it is not mandatory.
- In order to meet the deadline for withdrawal from the contract, it is sufficient for the Consumer to send information regarding the exercise of his right to withdraw from the contract before the deadline to withdraw from the contract.
CONSEQUENCES OF THE CONTRACT WITHDRAWAL
- In case of contract withdrawal, the Seller returns to the Consumer all received payments, delivery costs included (apart from the additional costs resulting from a mode of delivery different than the cheapest one offered by the Seller, immediately, or not after 14 days from the day in which the Seller was informed about the Consumer’s decision to withdraw from the contract.
- The return payment will be done by the Seller in the same way as the initial payment was done by the Consument unless the Consumer agrees to a different solution, in both cases the Consumer will not be obliged to pay any fees related to this return.
- The Seller may withhold the return payment until the product is returned or until the proof of return is presented, depending which event will take place sooner.
- The Seller requests the product to be returned to the address: Bielawa, Żeromskiego 39/30 immediately or in any case no later than 14 days from the date in which the Buyer informed the Seller about the withdrawal from the contract. The deadline is met if the Consumer returns the product within 14 days.
- The Consumer bears the direct cost of the return of the product.
- The Consumer is only liable for the decrease of the value of the product resulting from using the product in a way that was not necessary to assert the character, features and functioning of the product.
- If the product cannot be returned due to its nature by post, the Consumer will bear the direct cost of the return of the product. The Consumer will be informed by the Seller about these estimated costs in the product description in the Shop or during order placement.
- 8 EXCEPTIONS TO THE RIGHT OF CONTRACT WITHDRAWAL
- The Consumer is not entitled to the right to withdraw from the distance contract in relation to the contract:
- in which the object of performance is not a prefabricated item which was produced specifically and on the instructions of the Consumer to satisfy their individualized needs.
- in which the object of performance is an item liable to deteriorate or expire quickly.
- in which the object of performance is an item delivered in an sealed package, which cannot be returned due to health or hygienic reasons if the package was opened after the delivery.
- in which the objects of performance are items which after the delivery, due to their nature, become inseparably connected to other items.
- in which the objects of performance are sound or visual recordings or software delivered in a sealed package, if the package was opened after the delivery.
- for delivery of the newspapers, periodicals or magazines, with the exception of a subscription contract.
- in which the price or consideration is dependent on the fluctuations of the financial market on which the entrepreneur has no control over and which may occur before the deadline for the contract withdrawal.
- for providing digital content, which is not recorded on a tangible medium, if the fulfillment of the performance began on an express agreement of the Consumer before the deadline to withdraw from the contract and informing them by the entrepreneur about the loss of right to the contract withdrawal.
- 9 COMPLAINTS
- In the event of a defect of the product the Buyer may make a complaint about the defective goods on the basis of the Civil Code regulated warranty or guarantee, if the guarantee has been granted.
- Claiming the warranty, the Buyer may, on the basis and dates stated in the Civil Code:
- submit a price reduction statement
- in the event of a substantial defect – submit a statement of withdrawal from the contract
- demand a replacement to a product without defects
- demand the removal of the defect
- The complaints based on the warrant should be submitted to the postal or email address indicated in § 2 of the Regulations.
- Should the delivery of the complained product to the Seller be necessary in order to consider the complaint, the Buyer is obliged to deliver the product, at the Seller’s expense in case of the Consumer, for the Bielawa, Żeromskiego 39/30 address.
- If the product has additional guarantee granted, the information about it and its terms is available in the product description in the Shop.
- Complaint regarding the functioning of the Shop must be sent to the email address indicated in § 2 of the Regulations.
- Consideration of the complaint by the Seller will take place within 14 days.
EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND PURSUING CLAIMS
- Should the complaint procedure would not produce results expected by the Consumer, the Consumer can resolve to:
- mediation conducted by the competent Provincial Inspectorate of Trade Inspection to which you should apply for mediation. As a rule, the procedure is free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
- assistance of the competent local permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which an application for consideration of the case before the arbitration court should be submitted. - the ODR internet platform, available here: http://ec.europa.eu/consumers/odr/.
- 10 PERSONAL DATA
- The administrator of the personal data provided by the Buyer while using the Shop is the Seller.
- The Buyer’s personal data is processed based on the contract for the purposes of its fulfillment, in accordance with the regulations determined in the general data protection regulation (GDPR) of the European Union and the European Council (EU). Detailed information regarding processing data by the Seller is included in the Shop’s privacy policy.
- 11 DISCLAIMERS
- It is forbidden for the Buyer to provide illegal content.
- Each placed order in the Shop constitutes a separate sales contract and requires separate acceptance of the Regulations. Contract is concluded for specific time and for the purposes of the order fulfillment.
- The contracts concluded on the basis of these regulations are concluded in English.
- None of these regulations exclude in any way nor limits Consumer’s rights resulting from the provisions of the law.
- Provisions regarding products and sales contracts are applied respectively to digital content and the contract for providing digital content, if not stated otherwise in the Regulations.
- 12 PROVISIONS CONCERNING BUYERS WHO ARE NOT CONSUMERS
- The right to withdraw from the distance contract is not available for any entity different than the Consumer.
- Any liability of the Seller towards the Buyer who is not a Consumer is excluded.
- In the event of possible dispute with a Buyer who is not a Consumer, the competent court will be the competent Court of the Seller’s residence.

- 3 TECHNICAL REQUIREMENTS
- For the correct functioning of the Shop and setting up the Account, it is necessary to have:
- an active email account
- a device connected to the internet
- an internet browser supporting Javascript and cookie files
- 4 ACCOUNT
- Setting up the Account is completely voluntary and dependent on the will of the Buyer.
- The Account gives the Buyer additional possibilities, such as: viewing the history of orders placed by the Buyer in the Shop, checking the order status or editing personal data of the Buyer.
- In order to set up an Account, an appropriate form in the Shop must be completed.
- At the moment of setting up an Account, a contract is concluded for an indefinite period of time between the Buyer and the Seller for the scope of keeping the Account based on regulations indicated in these regulations.
- The Buyer can cancel the Account at any time without incurring any costs.
- To cancel the Account, resignation must be sent to the Seller, to music@cirodammicco.com, which will result in an immediate cancellation of the Account and the termination of the contract for the scope of keeping an Account.
- 5 COMPLAINTS
- Complaints regarding the functioning of the Account must be sent to the email address: music@cirodammicco.com.
- Consideration of the complaint will take place up to 14 days.

- 6 PERSONAL DATA

- The Buyer’s personal data is processed based on the contract for the purposes of its fulfillment, in accordance with the regulations determined in the general data protection regulation (GDPR) of the European Union and the European Council (EU). Detailed information regarding processing data by the Seller is included in the Shop’s privacy policy.
- 7 DISCLAIMERS
- It is forbidden for the Buyer to provide illegal content.
- Account keeping contract is written and concluded in English.
- In the event of important reasons, named in paragraph 4, coming into existence, the Seller has a right to amend these account regulations.
- Important reasons, aforementioned in paragraph 3., include:
- necessity to adapt the Shop to legal regulations applicable to the functioning of the Shop
- improvement of the security of provided service
- adaptation of the functionality of the Account which would require modification of the Account’s regulations
- The Buyer will be informed about any planned adaptations to the regulations 7 days prior to the implementation of the regulation through an email sent to the email account assigned to the Account.
- Should the Buyer not accept the planned adaptation, they ought to inform the Seller by sending appropriate message to Seller’s email address: music@cirodammicco.com, which will result in termination of the contract for keeping the Account at the moment of implementation of aforementioned adaptation or before that on the Buyer’s demand.
- Should the Buyer not object to the planned adaptation until its implementation, it is assumed that they accept it, which is not an obstacle towards termination of the contract in the future.
- In the event of possible dispute with a Buyer who is not a Consumer, the competent court will be the competent Court of the Seller’s residence.
- None of these regulations exclude in any way nor limits Consumer’s rights resulting from the provisions of the law.
